               Tiekėjas, norėdamas iki pirkimo sutarties sudarymo ginčyti perkančiosios organizacijos sprendimus ar veiksmus, turi pateikti pretenziją perkančiajai organizacijai Viešųjų pirkimų įstatymo VII skyriuje nustatyta tvarka. Perkančiosios organizacijos priimtas sprendimas gali būti skundžiamas teismui Viešųjų pirkimų įstatymo VII skyriuje nustatyta tvarka.

               Perkančioji organizacija nagrinėja tik tas tiekėjų pretenzijas, kurios gautos iki pirkimo sutarties sudarymo dienos, laikantis Viešųjų pirkimų įstatymo VII skyriuje nustatytų terminų.

               Perkančioji organizacija, gavusi pretenziją, nedelsdama sustabdo pirkimo procedūrą, kol bus išnagrinėta ši pretenzija ir priimtas sprendimas.
