Tiekėjas turi teisę pateikti pretenziją perkančiajai organizacijai, pateikti prašymą ar pareikšti ieškinį teismui (išskyrus ieškinį dėl pirkimo sutarties pripažinimo negaliojančia): 1.1 per 15 dienų nuo perkančiosios organizacijos pranešimo raštu apie jos priimtą sprendimą išsiuntimo tiekėjams dienos; 1.2 per 10 dienų nuo paskelbimo apie perkančiosios organizacijos priimtą sprendimą dienos, jeigu Viešųjų pirkimų įstatyme nėra reikalavimo raštu informuoti tiekėjus apie perkančiosios organizacijos priimtus sprendimus. 2.
